Terms & Conditions
These Terms and Conditions (“Agreement”) govern the relationship between you and Cosmo Luxe Voyage’s (“Agency,” “we,” “us,” or “our”) in connection with travel planning and booking services. By engaging our services, you acknowledge and agree to be bound by the terms herein.
1. Role of Agency
1.1 Independent Advisor – We act solely as a travel advisor arranging travel services through third-party suppliers, including but not limited to cruise lines, airlines, hotels, tour operators, and ground transportation providers (“Suppliers”).
1.2 No Ownership or Control – We do not own, manage, or operate any Suppliers. All travel services are provided directly by the Supplier and are subject to their terms, conditions, and policies.
1.3 Host Agency Payments – All payments are processed directly through our host agency, WorldVia, and not through Cosmo Luxe Voyage’s.
2. Quotes, Pricing & Payments
2.1 Quotes – All price quotes are subject to change until payment is confirmed by the Supplier.
2.2 Payments – Payments must be made directly to the host agency or Supplier, as specified at the time of booking.
2.3 Non-Refundable Fees – Any professional service fees charged by [Your Business Name] are non-refundable and separate from Supplier costs.
2.4 Currency & Exchange Rates – Pricing may be subject to currency fluctuations. Final amounts due will reflect the rate at the time of payment.
3. Cancellations, Changes & Refunds
3.1 Supplier Policies Govern – All cancellation, change, and refund requests are governed by the respective Supplier’s terms and conditions.
3.2 Agency Fees – Our professional service fees are non-refundable under any circumstances.
3.3 Client Responsibility – You are responsible for reviewing and understanding Supplier policies before booking.
4. Travel Documentation & Requirements
4.1 Passports & Visas – Clients are solely responsible for ensuring possession of valid passports, visas, and other required travel documentation prior to departure.
4.2 Health & Safety Requirements – Clients are responsible for meeting all health, vaccination, and safety requirements imposed by Suppliers, governments, or destinations.
4.3 Denied Entry/Boarding – The Agency is not liable for costs or losses due to denied boarding, refusal of entry, or inadequate documentation.
5. Travel Insurance
5.1 Recommendation – We strongly recommend the purchase of comprehensive travel insurance, including coverage for cancellation, medical emergencies, trip interruption, delays, and baggage loss.
5.2 Waiver of Insurance – If you decline travel insurance, you assume full financial responsibility for all associated risks and losses.
6. Limitation of Liability
6.1 No Liability for Suppliers – We are not liable for the acts, omissions, negligence, or default of any Supplier. This includes but is not limited to delays, cancellations, accidents, loss, damage, or bankruptcy.
6.2 Force Majeure – We are not responsible for events beyond our control, including natural disasters, pandemics, strikes, political instability, government actions, or travel restrictions.
6.3 Maximum Liability – In no event shall our liability exceed the amount of service fees paid directly to [Your Business Name].
7. Client Obligations
By booking with us, you agree to:
• Review all travel documents for accuracy immediately upon receipt.
• Notify us of any discrepancies within 24 hours.
• Comply with all Supplier requirements, rules, and regulations.
8. Governing Law & Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any legal action shall be brought exclusively in the courts of Miami-Dade County.
9. Acceptance of Terms
By paying a deposit or otherwise securing travel arrangements through Cosmo Luxe Voyage’s, you acknowledge that you have read, understood, and agreed to these Terms & Conditions, as well as those of the relevant Suppliers.
